Terms of Service

These Terms of Service (the "Terms") govern access to and use of the Shinkiro platform (the "Service"), operated by Seeds Analytic SAS ("Seeds Analytic", "we"). By creating an account or using the Service, you accept these Terms.

1. Service description

Shinkiro is a multi-tenant SaaS platform that lets businesses deploy AI-powered customer support agents. The agents answer questions using RAG over the customer's knowledge base and integrate WhatsApp Business and an embeddable web widget.

2. Accounts

To use the Service you must create an account and provide accurate, up-to-date information. You are responsible for keeping your credentials confidential and for all activity carried out under your account.

3. Acceptable use

You agree not to use the Service to:

  • Carry out unlawful activities or activities that infringe third-party rights.
  • Send spam, unsolicited messages, or fraudulent or misleading content.
  • Upload illegal, defamatory, harmful, or privacy-violating content.
  • Compromise the security, integrity, or availability of the platform.
  • Violate the policies of integrated channels, including Meta and WhatsApp Business.

4. Customer content

You retain ownership of the documents, knowledge bases, and other content you upload to the Service ("Customer Content"). You grant us a limited license to process such content solely to provide the Service. You are responsible for holding the necessary rights over the Customer Content and for processing it in accordance with the law.

5. Plans, tiers, and billing

The Service is offered under different plans or tiers. The fees, limits, and conditions of each plan are shown at the time of purchase. Payments are handled by third-party payment processors. Unless the law provides otherwise, amounts paid are non-refundable once the Service for the corresponding period has been provided.

6. Intellectual property

The Service, its software, trademarks, and other elements are the property of Seeds Analytic SAS or its licensors. These Terms do not transfer any intellectual property rights in the Service to you beyond the right of use described herein.

7. Availability and disclaimer of warranties

The Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted or error-free, nor that the responses generated by the AI agents will always be accurate or complete. The customer is responsible for reviewing and supervising automated responses as appropriate for its use case.

8. Limitation of liability

To the extent permitted by law, Seeds Analytic SAS shall not be liable for indirect, incidental, or consequential damages arising from the use of or inability to use the Service. Our total liability shall be limited to the amount paid for the Service during the twelve (12) months preceding the event giving rise to the claim.

9. Suspension and termination

You may cancel your account at any time. We may suspend or terminate access to the Service in the event of a breach of these Terms, misuse, or legal requirement. Upon termination, our data deletion policy applies.

10. Changes

We may update these Terms from time to time. We will publish the current version on this page with its last updated date. Continued use of the Service constitutes acceptance of the changes.

11. Governing law

These Terms are governed by the laws of the Republic of Colombia. Any dispute shall be submitted to the competent courts of Colombia.
